Police Officer Arrested For Having Physical Encounter With The Victim On Duty

A West Seneca police officer has been arrested for having physical intercourse with a victim of domestic violence while he was on duty.

35-year-old Derek Vasquez was charged with official misconduct after his arrest this week.

The district attorney’s office states he had a physical encounter with a woman while on duty in January 2019.

The DA’s office states that while he was investigating a domestic violence event involving the victim, he allegedly built a bond with that victim.

District Attorney John Flynn states the relationship was consensual.

Flynn said that “The accusation is that, while this officer was carrying an investigation, into a domestic violence incident, he built a relationship with the victim of that domestic violence event, a consensual link, to be fair, but there is an accusation that on one moment he presented himself, at her house while he was on duty, while he was in uniform, for the goal of a physical encounter and not to examine a crime.”

The 35-year-old officer is on administrative leave and is set for trial on January 24, 2024.

The police officers must not conduct any offense or any physical encounter while on duty.

The officials have not released the identity of the victim.

The authorities have not released further information about the case as the investigation of the matter is ongoing.
